Byteworks Limited – Terms and Conditions

These Terms and Conditions (“Agreement”) govern your access to and use of the services provided by Byteworks Limited, a fitness and nutritional gym (“Byteworks”, “we”, “us”, or “our”), including in-person and digital programs, memberships, and subscriptions. By accessing or using our services, you agree to be bound by this Agreement.

1. Eligibility
You must be at least 18 years old to register or subscribe to Byteworks’ services. By agreeing to these terms, you represent that you are of legal age and capable of entering into a binding contract.

2. Services Offered
Byteworks provides:
Fitness training programs (individual and group)

Nutritional coaching and diet planning

Virtual classes and programs

Customized subscription packages (monthly, quarterly, or annually)

3. Membership and Subscriptions
Subscriptions are billed based on the plan selected (monthly, quarterly, or annually).

Your membership will automatically renew at the end of each billing cycle unless you cancel prior to renewal.

By subscribing, you agree to recurring billing based on your selected plan.

4. Payment Authorization
By providing your payment information to Byteworks Limited, you authorize Byteworks to charge the designated payment method for any purchases or subscription fees incurred.
You affirm that you are an authorized user of the card or account and that you will not dispute the charges with your financial institution provided the transactions correspond to the terms indicated in this agreement.
In cases of recurring or subscription payments, you authorize Byteworks to automatically charge your payment method on a recurring basis until the service is canceled in accordance with our cancellation policy.
Byteworks reserves the right to suspend or terminate access to services if any payment is reversed or disputed without prior communication and resolution attempts.

5. Cancellations
You may cancel your subscription at any time by notifying us via your account dashboard or contacting our customer support.

Cancellation requests must be received at least 48 hours before the next billing cycle to avoid further charges.

No partial refunds will be issued for unused days in a billing cycle.

6. Refund Policy
We strive to ensure satisfaction with all services. However, our refund policy is as follows:
One-time Sessions or Classes: Refunds are allowed only if cancellation is made at least 24 hours in advance.

Subscription Packages: All payments for subscriptions are non-refundable once the billing cycle has begun.

Introductory Offers or Promotions: These are non-refundable and not subject to proration.

Medical Exemptions: Refunds may be considered for verified medical issues that prevent continued participation.

All refund requests must be sent in writing to support@byteworksfit.com with relevant documentation

7. Subscription Disputes
If you believe you were wrongly charged, please contact us within 7 days of the billing date. We will review the transaction and respond within 10 business days.
Unresolved disputes raised directly with your bank or payment provider without first attempting resolution with Byteworks may result in immediate suspension of your account.
Byteworks will not be responsible for bank fees, overdraft charges, or reversal penalties incurred from unauthorized disputes initiated without prior communication.

8. Termination of Services
Byteworks may terminate or suspend your account if:
Payment is declined or disputed.

You violate any terms outlined in this Agreement.

You engage in misconduct, abuse, or pose a safety risk to other members or staff.

9. Health Disclaimer
Participation in fitness or nutritional programs involves risk. You acknowledge that you are responsible for your own health and agree to consult a medical professional before beginning any program with Byteworks.

10. Limitation of Liability
Byteworks is not liable for:
Injuries sustained while participating in programs.

Misuse or misinterpretation of nutritional advice.

Third-party service disruptions.

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles.

12. Changes to Terms
Byteworks reserves the right to update these Terms and Conditions at any time. Changes will be posted on our website and will take effect immediately upon publication.
